These License Terms ("Terms") govern your purchase and use of the Djangify eBuilder Pro License ("License"). By purchasing and using the License, you agree to be bound by these Terms.

Definitions

"eBuilder" refers to the Djangify eBuilder open-source eCommerce platform software available at https://github.com/djangify/ebuilder

"License" refers to the eBuilder Pro License purchased from todiane.com

"License Key" refers to the unique activation code provided upon purchase

"You" or "Licensee" refers to the individual or entity purchasing the License

"We" or "Licensor" refers to Diane Corriette, trading as todiane.com

"Production Domain" refers to a single publicly accessible domain name or subdomain where eBuilder is deployed for live use

License Grant

Upon payment of the License fee, we grant you a non-exclusive, non-transferable, perpetual license to:

✅ Remove the "Powered by Djangify eBuilder" footer branding from your eBuilder installation

✅ Use the License on one (1) Production Domain

✅ Use the License on unlimited development, staging, and testing environments

✅ Modify the eBuilder source code for your own use

✅ Receive all future updates and improvements to eBuilder at no additional cost

✅ Use eBuilder for client projects (one license required per client Production Domain)

License Restrictions

You may not:

❌ Share, distribute, or resell your License Key

❌ Use a single License on multiple Production Domains (purchase separate licenses for each domain)

❌ Redistribute eBuilder with your License Key embedded

❌ Remove or alter copyright notices in the eBuilder source code

❌ Use the License in any way that violates applicable laws or regulations

Payment & License Type

One-Time Payment: The License fee at its current price is a one-time payment. There are no recurring charges.

Single Domain: Each License is valid for one Production Domain. If you need to use eBuilder on multiple domains, you must purchase additional licenses.

Perpetual License: Your License does not expire. Once purchased, it is valid indefinitely.

Support & Updates

Email Support: You receive email support for installation and license activation questions at djangify@djangify.com

Response Time: We aim to respond to support requests within 24-48 hours during business days

What's Included:

Installation assistance of your license
License activation troubleshooting
Bug reports

What's Not Included:

Custom development or feature requests
Server setup, hosting, or infrastructure support
Third-party plugin or integration support
Urgent or emergency support

Updates: All future updates to eBuilder are included with your License at no additional cost. Updates are released via the GitHub repository.

Refund Policy

30-Day Money-Back Guarantee

If you are not satisfied with eBuilder for any reason, you may request a full refund within 30 days of your purchase date.

To request a refund:

Email djangify@djangify.com with your order number
Include "Refund Request" in the subject line
We will process your refund within 5-7 business days
No questions asked. We want you to be happy with your purchase.

After 30 days, all sales are final.

Open Source & Code Modifications

eBuilder is open-source software licensed under the MIT License. The eBuilder Pro License specifically grants you the right to remove footer branding.

You may:

Modify the eBuilder source code freely
Extend functionality for your own use
Remove or customize any features
You may not:

Claim eBuilder as your own creation
Remove copyright and attribution notices from the source code
Redistribute a modified version as "Djangify eBuilder"

Ownership & Intellectual Property

eBuilder Code: The eBuilder software remains open source under the MIT License

License Key: Your License Key is your property and grants you branding removal rights

Trademarks: "Djangify," "eBuilder," and associated logos are trademarks of todiane.com

Your Content: You retain all rights to content, products, and data you create or upload using eBuilder

Warranty Disclaimer

THE LICENSE AND EBUILDER SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

We make no warranties, express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
That eBuilder will be error-free or uninterrupted
That eBuilder will meet your specific requirements
That defects will be corrected

Your Use at Your Own Risk: You assume all responsibility for selecting eBuilder to achieve your intended results and for the installation, use, and results obtained from it.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Your use or inability to use eBuilder
Any unauthorised access to or use of your data
Any bugs, viruses, or other harmful code
Any errors or omissions in eBuilder
Any downtime or service interruption
Maximum Liability: Our total liability to you for all claims arising from your purchase shall not exceed the amount you paid for the License - current price December 2024 £49.99 GBP.

Termination

By You: You may stop using your License at any time. Termination does not entitle you to a refund after the 30-day refund period.

By Us: We may terminate your License if you:

Breach these Terms
Use the License fraudulently
Share or resell your License Key
Use eBuilder for illegal purposes

Upon termination:

Your branding removal rights end
You must stop using your License Key
You may continue using eBuilder with footer branding (open source version)

License Transfer

Licenses are non-transferable except in the following cases:

Business Acquisition: If your business is acquired, the License may transfer to the acquiring entity with our prior written consent.

Domain Change: If you need to change your Production Domain (e.g., rebrand, new domain name), contact us at djangify@djangify.com. We will accommodate reasonable requests made within the first year only.

Between Personal/Business: You may transfer the License between your personal and business entities if you are the sole owner of both.

Updates to These Terms

We may update these Terms from time to time. Changes will be posted here with an updated "Last Updated" date.

Material Changes: If we make material changes that negatively affect your rights, we will notify you via email at least 30 days before the changes take effect.

Continued Use: Your continued use of your License after changes take effect constitutes acceptance of the updated Terms.

Privacy

Your purchase information and use of eBuilder are subject to our Privacy Policy at https://todiane.com/privacy-policy

We collect:

Email address and payment information (via Stripe)
License activation data
We do not:

Track your eBuilder usage
Access your customer data
Sell your information to third parties

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Any disputes shall be resolved in the courts of England and Wales.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding your License purchase.

These Terms supersede any prior agreements or communications.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
